Iddat period for Khula

QUESTION

what is the significance of the waiting period iddat in case of Khula? Can the wife return to the husband during this time or is the nikah over as soon as husband grants Khula?and how long is this iddat period in Khula?

Answer

The Iddah period is applicable in the scenario mentioned, as a Khula (mutually agreed divorce) is the equivalent of one Talaq Ba'in (irrevocable divorce). It should be noted that the Iddah period of waiting three menstrual cycles is applicable when the wife wishes to marry other than the former husband.

However, if the former husband has divorced the wife less than three times in total, the former husband and wife may agree to remarry with a new Nikah ceremony and a new Mahr within the Iddah period.

مَطْلَبٌ فِي الْعَقْدِ عَلَى الْمُبَانَةِ
قَوْلُهُ : (وَيَنْكِحُ مُبَانَتَهُ بِمَا دُونَ الثَّلَاثِ ) لَمَّا ذَكَرَ مَا يُتَدَارَكُ بِهِ الطَّلَاقُ الرَّجْعِيُّ ذَكَرَ مَا يُتَدَارَكُ بِهِ غَيْرُهُ .فَتْحٌ. وَلِذَا عَقَدَ لَهُ فِي الْهِدَايَةِ هُنَا فَصْلًا ( قَوْلُهُ : بِالْإِجْمَاعِ ) رَاجِعٌ إلَى قَوْلِهِ فِي الْعِدَّةِ وَهُوَ جَوَابٌ عَنْ سُؤَالٍ هُوَ أَنَّ قَوْلَهُ : { وَلَا تَعْزِمُوا عُقْدَةَ النِّكَاحِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَه } يَعْنِي انْقِضَاءُ الْعِدَّةِ عَامٌّ ، فَكَيْفَ جَازَ لِلزَّوْجِ تَزَوُّجُهَا فِي الْعِدَّةِ وَالنَّصُّ بِعُمُومِهِ يَمْنَعُهُ.

وَالْجَوَابُ أَنَّهُ خُصَّ مِنْهُ الْعِدَّةُ مِنْ الزَّوْجِ نَفْسِهِ بِالْإِجْمَاعِ ( قَوْلُهُ : وَمُنِعَ غَيْرُهُ ) أَيْ غَيْرُ الزَّوْجِ فِي الْعِدَّةِ لِاشْتِبَاهِ النَّسَبِ بِالْعُلُوقِ ، فَإِنَّهُ لَا يُوقَفُ عَلَى حَقِيقَتِهِ أَنَّهُ مِنْ الْأَوَّلِ ، أَوْ الثَّانِي ، وَهَذَا حِكْمَةُ شَرْعِيَّةِ الْعِدَّةِ فِي الْأَصْلِ...
