Mustahaadah and being Ma'dhoor

QUESTION

Assalamu 'alaikum wa rahmatullah,If a woman experiences invalid bleeding (istihaadhah), does she automatically consider herself to be in the ruling of a ma'dhoor, hence doing a new wudhu from the next salah time? Or does she have to wait for the duration of 1 salah time? Does she have to do istinjah before wudhu and is it fine for her to pray with a soiled sanitary towel? JazaakumAllah.

In general, it should be noted that the bleeding which lasts for more than 3 days and less than 10 days is regarded as menstruation, whereas the bleeding which lasts for less than 3 days or continues for more than 10 days, is in the ruling of Istihadha (dysfuntional bleeding).

The ruling of Istihadha is applicable as soon as blood is seen in the relevant time, for example after the 10 days have elapsed. In this situation of Istihadha, it is obligatory to immediately take a Ghusl (purifactory bath) and from then on to pray as normal, one must not wait for a prayer time to elapse. It should also be clear that one is not required to do Istinja before Wudu (ablution) unless one has passed stool or urine, however if any blood is seen on one's body, it should be washed away.

Regarding praying with a soiled sanitary towel, since such a  towel is worn externally, the blood which does exit the body would invalidate the wudu and also make the towel impure. Thus, in this situation wearing a soiled sanitary towel during prayer would not be permissible.

Also if blood is exiting the body due to Istihadha, the ruling of being Mazur (excused) is not automatically applicable, rather it is applicable when the bleeding has lasted for an entire prayer time. It should also be noted that only if the bleeding then stops for an entire Salah time, the ruling of being Mazur will then no longer apply.

فَإِنْ تَوَضَّأَتْ الْمُسْتَحَاضَةُ فِي وَقْتِ الظُّهْرِ وَصَلَتْ وَالدَّمُ سَائِلٌ ثُمَّ انْقَطَعَ دَمُهَا فَصَلَاتُهَا تَامَّةٌ لِبَقَاءِ الْعُذْرِ إلَى الْفَرَاغِ مِنْ الصَّلَاةِ ، وَإِنْ كَانَ الِانْقِطَاعُ قَبْلَ الشُّرُوعِ فِي الصَّلَاةِ أَوْ فِي خِلَالِ الصَّلَاةِ فَعَلَيْهَا إعَادَةُ الْوُضُوءِ وَالصَّلَاةِ ؛ لِأَنَّهَا صَلَّتْ بِطَهَارَةِ ذَوِي الْأَعْذَارِ بَعْدَ زَوَالِ الْعُذْرِ وَهَذَا إذَا تَمَّ الِانْقِطَاعُ وَقْتَ صَلَاةٍ أَوْ أَكْثَرَ فَإِنْ كَانَ أَقَلَّ مِنْ ذَلِكَ فَصَلَاتُهَا تَامَّةٌ ؛ لِأَنَّ الْقَلِيلَ مِنْ الِانْقِطَاعِ غَيْرُ مُعْتَبَرٍ فَإِنَّ صَاحِبَةَ هَذِهِ الْبَلْوَى لَا تَكَادُ تَرَى الدَّمَ عَلَى الْوَلَاءِ وَلَكِنَّهُ يَسِيلُ تَارَةً وَيَنْقَطِعُ أُخْرَى ؛ لِأَنَّهَا لَوْ رَأَتْ الدَّمَ عَلَى الْوَلَاءِ أَضْنَاهَا ذَلِكَ وَرُبَّمَا يَكُونُ سَبَبًا لِهَلَاكِهَا فَجَعَلْنَا الْقَلِيلَ مِنْ الِانْقِطَاعِ عَفْوًا وَجَعَلْنَا الْفَاصِلَ بَيْنَ الْقَلِيلِ وَالْكَثِيرِ وَقْتَ صَلَاةٍ كَامِلًا اعْتِبَارًا لِلِانْقِطَاعِ بِالسَّيَلَانِ فَإِنَّ السَّيَلَانَ إذَا كَانَ دُونَ وَقْتِ صَلَاةٍ لَا يَثْبُتُ بِهِ حُكْمُ الِاسْتِحَاضَةِ وَإِذَا كَانَ وَقْتَ صَلَاةٍ أَوْ أَكْثَرَ يَثْبُتُ بِهِ حُكْمُ الِاسْتِحَاضَةِ وَكَذَلِكَ الِانْقِطَاعُ إذَا كَانَ دُونَ وَقْتِ صَلَاةٍ لَا يَكُونُ بَرَأَ ، وَإِنْ كَانَ وَقْتَ صَلَاةِ أَوْ أَكْثَرَ كَانَ بَرَأَ وَاَللَّهُ أَعْلَمُ بِالصَّوَابِ.

أَيْ وَحُكْمُ الِاسْتِحَاضَةِ وَالْعُذْرِ يَبْقَى ( قَوْلُهُ : وَهَذَا إذَا لَمْ يَمْضِ عَلَيْهِمْ وَقْتُ فَرْضٍ إلَّا وَذَلِكَ الْحَدَثُ يُوجَدُ فِيهِ )

إذَا لَمْ يَمْضِ عَلَى أَصْحَابِهِمَا وَقْتُ صَلَاةٍ إلَّا وَالْحَدَثُ الَّذِي اُبْتُلِيَتْ بِهِ يُوجَدُ فِيهِ وَلَوْ قَلِيلًا حَتَّى لَوْ انْقَطَعَ وَقْتًا كَامِلًا خَرَجَ عَنْ كَوْنِهِ عُذْرًا قَيَّدْنَا بِكَوْنِهِ شَرْط الْبَقَاءَ ؛ لِأَنَّ شَرْطَ ثُبُوتِهِ ابْتِدَاءً بِأَنْ يَسْتَوْعِبَ وَقْتًا كَامِلًا ، كَذَا فِي أَكْثَرِ الْكُتُبِ...
